ORDINANCE 2017-18

ORDINANCE AUTHORIZING THE CITY OF ZACHARY TO AMEND §8.211 OF THE UNIFIED DEVELOPMENT CODE FOR THE CITY OF ZACHARY TO PROVIDE BY AN AMENDMENT FOR THE CONNECTIVITY AND INCORPORATION OF BICYCLE ROUTES, LANES, PATHS AND TRAILS INTO THE DEVELOPMENT OF SUBDIVISIONS WITHIN THE CITY OF ZACHARY AND FOR OTHER MATTERS IN FUTHERANCE OF THIS PROVISION

WHEREAS, the City Council for the City (“City Council”) has determined that the City’s current Unified Development Code (the “UDC”), does not adequately address the City’s ability to control the connectivity and incorporation of bicycle routes, lanes, paths and trails into growth of development as they relate to the provisions of inter and infra-structural improvements within the City;

WHEREAS, the City believes that amendments to § 8.211 of the UDC are necessary to implement required the connectivity of  bicycle routes, lanes, paths and trails into new developments  as inter and infra-structural improvements of the same within the City;

THEREFORE BE IT ORDAINED by the City Council that §8.211(A) of the Unified Development Code for the City be hereby prospectively deleted as written and further amended to read:

        A. Bicycle Routes.  Bicycle routes lanes, paths and trails as designated on the City’s major street plan shall be designated on all site plans and primary plats, and shall be posted upon completion of the proposed development
                1. All parcels proposed for development shall be designed to incorporate and provide for internal connectivity or tie-in to all external bicycle route lanes, paths and trails designated by the City, is such external bicycle route, lane,                            path or trail designated by the City is immediately adjacent to and contiguous to the proposed development.
                2. All parcels proposed for development that are not adjacent to and contiguous to any external bicycle route, lane, path or trail designated by the City shall nevertheless be designed to provide for future incorporation and internal                          connectivity or tie-in to existing external bicycle route lanes, paths and trails designated by the City, unless such future connectivity and tie-in would be impossible, unreasonable or create an undue burden upon the proposed                            development.
                3. Consideration in design of all outdoor and open spaces intended for pedestrian amenity, recreational or other community activity shall be given for internal connectivity or tie-in to all external bicycle route lanes, paths and trails                          designated by the City.

This Ordinance shall become effective at the expiration of ten (10) calendar days after publication by the City Council for the City of Zachary  unless the referenced ordinance shall specify another effective date, all pursuant to § 2-10 (C) of the Home Rule Charter adopted by the electors for the City of Zachary.

INTRODUCED FOR ADOPTION by the City Council of the City of Zachary as a regular meeting of the said Council held on the 14th day of November, 2017.

ORDINANCE 2017-19

CITY OF ZACHARY
PARISH OF EAST BATON ROUGE
STATE OF LOUISIANA

ORDINANCE PERTAINING TO THE DECLARATION OF INTENT BY THE CITY OF ZACHARY TO HAVE THE CERTAIN MOVABLE PROPERTY DECLARED TO BE SURPLUS AND ALLOWING FOR THE DISPOSAL OF SAME

            WHEREAS, the City of Zachary (the “City”) owns certain movable property no longer of use to the City, in which it reasonably believes the cost of removal, repair and/or required maintenance of the same will exceed the value and usefulness to the City, it is the intention of the Mayor and the City Council of the City of Zachary to declare the property described as:

            Two (2) Liquid Storage Tanks-  # 22-9-0495-005-001 & # 22-2-0081-001-002
            One (1) 2006 Ford Expedition VIN 1FMPU15566LA58677 Mileage 125950
to be surplus property of the City, and to wit:

BE IT ORDAINED, by the City Council for the City of Zachary that the referenced property be considered to be surplus property of the City, and as such after any and all notice, hearing and legal delay be disposed of or sold at public auction.

This Ordinance shall become effective at the expiration of ten (10) calendar days after publication by the City Council for the City of Zachary  unless the referenced ordinance shall specify another effective date, all pursuant to § 2-10 (C) of the Home Rule Charter adopted by the electors for the City of Zachary.

INTRODUCED FOR ADOPTION by the City Council of the City of Zachary as a regular meeting of the said Council held on the 14th Day of November, 2017.
